1. Introduction

These Terms and Conditions ("Terms") govern your use of www.caratyears.com (the "Website") and your purchase of products from it. The Website is owned and operated by Carat Years GemsJewels Private Limited ("Company", "we", "us", "our"), with its flagship boutique at B-88, Defence Colony, New Delhi.

"You" or "User" refers to any person browsing, registering on, or purchasing from the Website. By using the Website, you confirm that you are at least 18 years of age or are using the Website under the supervision of a parent or guardian.

We reserve the right to update or revise these Terms at any time by posting the revised version on the Website. Continued use of the Website after such changes constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically.

2. Products

Carat Years offers fine jewellery featuring IGI-certified CVD lab-grown diamonds, available as ready-made pieces and custom or made-to-order designs, sold for personal use.

We take care to ensure product descriptions, images, and specifications are accurate. However:

• Product images are indicative. Due to screen display, lighting, and photography techniques, actual products may appear slightly different in size, shade, or finish.
• Precious metal weight and diamond weight mentioned on the Website are approximate and may vary slightly due to design and manufacturing processes.
• The Company is not liable for minor variations between the displayed image and the delivered product, provided the product conforms to the specifications stated at the time of purchase.

3. Certification

• All lab-grown diamonds sold by Carat Years are IGI (International Gemological Institute) certified.
• For studded jewellery, the certificate corresponds to the centre stone or as specified on the product page at the time of purchase. Smaller accent diamonds are not individually certified unless expressly stated.
• All gold used is BIS-hallmarked, certifying purity as displayed on the product page.

4. Pricing and Payment

• All prices on the Website are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Prices for gold jewellery are linked to prevailing gold rates and may fluctuate. The price applicable at the time of order confirmation and payment will be final.
• We reserve the right to correct any pricing errors. If an incorrect price is displayed due to a technical or human error, we will notify you before processing the order, and you may choose to proceed at the correct price or cancel the order for a full refund.
• Payments are processed through third-party payment gateways. By making a payment, you agree to the terms and privacy policy of the relevant payment gateway provider. The Company is not responsible for any fraud arising from misuse of your payment credentials.

5. Orders

• Placing an order on the Website constitutes an offer to purchase, which is accepted by the Company only upon confirmation of payment.
• We may contact you by phone or email to verify order details before dispatch.
• The Company reserves the right to refuse or cancel any order at its discretion, including in cases of suspected fraud, pricing errors, or unavailability of stock, in which case a full refund will be issued within a reasonable timeframe.
• For made-to-order or customised pieces, estimated production timelines will be communicated at the time of order and may vary based on design.

6. Delivery

• The Company will make reasonable efforts to deliver orders within the timeline communicated at checkout.
• At the time of delivery, the recipient must present a valid government-issued photo ID (Aadhaar, PAN, driving licence, voter ID, or passport) for verification.
• Please inspect your package at the time of delivery. Do not accept the package if it appears tampered with, opened, or damaged. Report any such issue immediately to our customer care team.
• The Company is not liable for delays caused by courier partners, incorrect address information provided by the customer, or events beyond our reasonable control (force majeure).

7. Returns

• Returns are accepted within 7 days of delivery
• To initiate a return, please write to us at care@caratyears.in with your order details, and our team will guide you through the next steps.
• The product must be in its original condition, free from damage, resizing, or alteration, unworn condition, with original packaging, invoice, and certificate intact.
• Customised or made-to-order jewellery is not eligible for return.
• Refunds will be processed to the original payment method within 5-7 business days from of the returned product passing quality inspection.
• Original IGI certificate required: ₹2,000 fee (plus GST) will be deducted if not produced, damaged, or lost.
• Our courier partner will collect the package from your address, fully insured, at no charge to you.

8. Exchange & Buyback Policy:

Buyback

• Carat Years does not offer a buyback programme.
• Recommended Alternative: We are committed to the lifetime value of every piece we create, through our Lifetime Exchange Policy, complimentary care services, and the enduring quality of every piece we make. We encourage customers to consider the Lifetime Exchange Policy as a meaningful alternative.

Exchange

• The product must be accompanied by the original invoice and the original certificate.
• The product must be in free from damage, resizing, or alteration.
• All exchange requests are subject to quality assurance verification by the Company, whose decision shall be final.
• A credit note will be issued for the exchange value, which can be redeemed against the purchase of any new item.
• Any discount or offer availed/provided on the original purchase will be deducted while ascertaining the exchange value.
• Exchange value will be as per below:
• Metal Value — 100% based on prevailing rate
• Diamond Value — 80% of diamond invoice value
• Making charges — Not adjustable
• GST — Not adjustable
• Original IGI certificate required: ₹2,000 fee (plus GST) will be deducted if not produced, damaged, or lost.

9. Intellectual Property

All content on this Website, including but not limited to text, images, logos, designs, and the Carat Years brand name and tagline, is the property of Carat Years GemsJewels Private Limited and is protected under applicable Indian intellectual property law. No content may be copied, reproduced, or distributed without our prior written consent.

10. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, and rules made thereunder. 11. Disclaimer of Warranties

The Website and its content are provided on an "as is" and "as available" basis. While we take care to ensure accuracy, we do not warrant that the Website will be uninterrupted, error-free, or that product information is entirely free from inadvertent errors or omissions.

12. Limitation of Liability

To the maximum extent permitted by law, the Company's total liability arising from your use of the Website or any purchase made through it shall not exceed the amount paid by you for the relevant product. The Company shall not be liable for any indirect, incidental, or consequential loss, including loss of profits or business opportunity.

13. Indemnity

You agree to indemnify and hold harmless Carat Years GemsJewels Private Limited, its directors, employees, and affiliates from any claim, loss, or damage, including reasonable legal costs, arising from your breach of these Terms or your violation of any applicable law.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from your use of the Website or purchases made through it shall be subject to the exclusive jurisdiction of the courts in New Delhi.
